It seems like there have been a lot of car break-ins lately in the Sycamore/Elsmere/Beck part of town between 9th and Parsons. I hope we can break that cycle!

Did you call 911 first? It does not say whether you did or not. The best course of action is to keep the perp in sight while calling 911. It allows you to describe the perp to the dispatcher who can relay it the responding officers allowing the officers to respond and hopefully catch the criminal in the act. I am sorry for your loss, but what did you think you were going to do armed when you confronted the criminal? Injure the bad guy? No person was in imminent danger of bodily harm or death. The Castle Doctrine has not yet had case law established to define if you may defend your car and even so, you were not in the car during the crime. I understand your desire, but by running out armed you simply scared him away, put yourself in danger, allowed him to escape and to perhaps victimize someone else. Please Call 911 – let the professionals deal with the criminal, be excellent eyes for the Police and hopefully they can catch him.

Glad to see that you weren’t shy about exercising your 2nd amendment rights.

First off I would have probably done the same thing. And sadly we BOTH would have been wrong.
Being prior Law Enforcement and a currant carrier of a concealed license I can tell you that in the state of Ohio you do not have the right to protect your property. Deadly force can never be used to protect property only. You only have the right to protect you or another’s life in the circumstances to prevent serious bodily harm or death.
Sadly it could be said that you instigated the altercation by brandishing the weapon if you went outside with it in your hand and therefore even if you were in immediate danger it could have been that the dirt bag was reacting to “YOUR” threat and therefore your fault.
If anyone is interested I know a very good CCW instructor in town.

Yes my girlfriend dialed 911 immediately. They did not pick up till after 8 rings. And then it was an hour later when they came. She was able to give a good description of the man. The street is very well lit and the truck was parked under a light as well. I am from the south and down there we have the ” Stand your ground” law. I am aware that law does not apply up here. I informed the police that I was armed.
